Breath Alcohol Laboratory Program


The breath alcohol program is responsible for the certification of agencies, instruments and officers, who test drivers suspected of being under the influence of alcohol. The program is responsible for breath testing under the aughority of K.S.A. 65-1,107. The administrative regulations implementing breath testing are K.A.R. 28-32-1 through 28-32-7.

Currently there are 240 law enforcement agencies certified for breath testing. Approximately 4000 certified officers are tested and recertified each year. The 217 instruments placed throughout the state are inspected and recertified each year by the staff. Breath alcohol staff support other functions of breath testing by providing standards which are used with every breath test, affidavits mandated for each drivers license hearing and testimony in DUI cases and at administrative proceedings.
